:funk: :funk: :funk: :funk: :funk: :funk:

The law in England has long recognised the right to salvage on the sea shore, especially between high and low water marks. Indeed, there is an ancient office of Commissioner of Wrecks to oversee such salvage locally. I understand that someone has already been identified in the area in which the salvaging has occurred. Magistrates, I think, carried out those duties. Magistrates also had the duty to secure wrecks (in the sense of taking charge of them) in order to sort out the exact status of wrecks and their cargoes. Indeed, if you care to look at section 35 of the Offences Against the Person Ordinance, Chapter 212 of the Laws of Hong Kong, although I cannot imagine why you would wish to, you will see that there is an offence of assaulting a magistrate going about his business of preserving any vessel in distress or wreck or their effects 'cast on shore'. Maximum penalty: seven years in prison. This offence made perfect sense to the Victorians who enacted this ordinance in 1865, especially bearing in mind the history of piracy on the South China Coast.

Going back to England, those in the West Country especially, were famed for encouraging perfectly sound ships to become wrecks by lighting their own fires in the hope of luring ships onto the rocks by confusing navigators as to the true positions of lighthouses. Daphne Du Maurier's book 'Jamaica Inn' is based on those times.

There is no doubt that there is right to salvage. However the law is complex and may well be attended by having to report one's findings. In any event, I think that we shall find many cheap BMW bikes/spares on eBay in the next few months!
